1. Acceptance of Terms

By accessing and using the NixBin LLC website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

NixBin LLC provides cybersecurity consulting, penetration testing, web hosting, server rental, infrastructure management, IT consulting, software development, and cybersecurity training services. All services are subject to separate service agreements and statements of work.

3. Authorization and Scope

All security testing and penetration testing services are performed only with explicit written authorization from the client. NixBin LLC operates strictly within the scope defined in each engagement agreement. Unauthorized testing of systems is prohibited.

4. Confidentiality

NixBin LLC treats all client data, findings, and engagement details as strictly confidential. We will not disclose any information about our clients or their security posture to third parties without explicit written consent, except as required by law.

5. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of NixBin LLC and is protected by applicable intellectual property laws. Custom tools and scripts developed during engagements remain the property of NixBin LLC unless otherwise specified in the service agreement.

6. Limitation of Liability

NixBin LLC provides cybersecurity services on a best-effort basis. While we strive to identify all vulnerabilities within the agreed scope, no security assessment can guarantee the discovery of every possible vulnerability. NixBin LLC shall not be liable for any damages arising from security incidents that occur outside the scope of our engagement or from the client's failure to implement recommended remediation measures.

7. Service Level Agreements

Hosting and infrastructure services are provided in accordance with specific Service Level Agreements (SLAs) defined in individual service contracts. SLA terms, including uptime guarantees and support response times, vary by service tier.

8. Payment Terms

Payment terms are established in individual service agreements. Unless otherwise specified, invoices are due within 30 days of issuance. NixBin LLC reserves the right to suspend services for accounts with overdue balances.

9. Termination

Either party may terminate a service engagement with 30 days written notice, unless otherwise specified in the service agreement. NixBin LLC reserves the right to immediately terminate services in cases of misuse, illegal activity, or violation of these terms.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

11. Changes to Terms

NixBin LLC reserves the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.
